These Terms of Service govern your access to and use of HERCHAT, including the website, AI companion chat, paid message packs, subscriptions, and related services.
1. Acceptance of these Terms
By accessing or using HERCHAT, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

HERCHAT provides AI companion conversations for entertainment, personal chat, and interactive digital companionship. The service may include free access, paid message packs, monthly subscriptions, and future companion characters.
3. AI companion disclosure
Luna and any other HERCHAT companion are AI-generated characters. They are not real humans and do not have real-world identity, emotions, personal life, legal capacity, or ability to meet users.
- Conversations are generated by artificial intelligence.
- Responses may be inaccurate, fictional, incomplete, or inappropriate.
- The AI may simulate warmth, personality, memory, or emotional tone, but this does not create a real relationship.
- HERCHAT does not guarantee that the AI will always remember, understand, or respond correctly.
4. Entertainment only
HERCHAT is provided for entertainment and conversational purposes only. The service is not intended to replace human relationships, professional support, therapy, medical care, legal advice, financial advice, or emergency services.
5. No professional advice
HERCHAT does not provide medical, mental health, legal, financial, tax, safety, or other professional advice. Do not rely on AI responses for important decisions. Always consult a qualified professional when needed.
6. No emergency use
HERCHAT is not an emergency service. If you believe you or someone else is in danger, contact local emergency services or a trusted person immediately.
7. Age requirement
HERCHAT is intended only for users who are at least 18 years old. By using HERCHAT, you confirm that you are at least 18 years old.
8. Account and login
You may need to provide an email address to access certain features. You are responsible for keeping your email account and device secure. You are also responsible for activity connected to your access to HERCHAT.
9. Free access and message limits
HERCHAT may offer a limited number of free messages. Free access can be changed, limited, paused, or removed at any time. Free messages do not guarantee permanent access to the service.
10. Paid message packs
HERCHAT may offer one-time message packs, including:
- Coffee Pack — extra messages as shown at checkout.
- Dinner Pack — extra messages as shown at checkout.
Message packs are digital consumable products. They are activated after successful payment where technically available. Used messages are not refundable.
11. Monthly subscriptions
HERCHAT may offer monthly subscriptions such as Month with Luna. A monthly subscription may include a monthly message allowance, memory features, history, or other benefits shown at the time of purchase.
Subscription features, limits, and pricing may change over time. Existing users will be handled according to the billing settings and applicable law.
12. Payments
Payments are processed through Stripe or another payment provider shown at checkout. HERCHAT does not store full credit card numbers on its own servers.
By purchasing a paid option, you agree to the price, billing period, and product details shown at checkout.
13. Cancellation
Monthly subscriptions may be cancelled according to the Stripe billing flow or by contacting support. Cancellation stops future billing but does not automatically refund already paid periods unless required by law or explicitly approved by HERCHAT.
14. Refund policy
Because HERCHAT provides digital access and consumable message credits, refunds are generally not provided once digital access, message credits, or subscription access has been delivered.
HERCHAT may review refund requests case by case, especially in cases of technical failure, duplicate payment, or accidental billing. Contact support at support@herchat.online.
15. Acceptable use
You agree not to use HERCHAT to:
- break the law or encourage illegal activity,
- harass, threaten, exploit, or harm others,
- generate or request sexual content involving minors,
- attempt to bypass limits, payment systems, or safety features,
- scrape, copy, attack, overload, or reverse engineer the service,
- upload malware, spam, or harmful code,
- misrepresent HERCHAT AI companions as real people.
16. Content and user messages
You are responsible for the messages you send. By using HERCHAT, you allow us to process your messages to provide AI replies, memory features, chat history, safety, and service functionality.
17. AI output
AI-generated responses may be fictional, incorrect, incomplete, or unsuitable. HERCHAT does not guarantee accuracy, availability, emotional benefit, or any specific result from using the service.
18. Availability and changes
HERCHAT may be updated, modified, interrupted, or discontinued at any time. We may change features, message limits, companion personalities, pricing, and technical providers as the service develops.
19. Suspension or termination
We may restrict, suspend, or terminate access if we believe a user has violated these Terms, abused the service, attempted fraud, caused technical harm, or created legal or safety risk.
20. Intellectual property
HERCHAT, its design, brand, characters, website, code, text, and related materials are owned by HERCHAT or its licensors. You may not copy, resell, or redistribute the service without permission.
21. Third-party services
HERCHAT may rely on third-party services such as hosting providers, AI model providers, Stripe, analytics tools, and email systems. These services may have their own terms and privacy policies.
22. Limitation of liability
To the maximum extent permitted by law, HERCHAT is provided “as is” and “as available.” We are not liable for indirect, incidental, special, consequential, emotional, financial, or business losses arising from use of the service.
23. No warranty
We do not guarantee that HERCHAT will be uninterrupted, error-free, secure, accurate, emotionally satisfying, or suitable for your expectations.
24. Privacy
Your use of HERCHAT is also governed by our Privacy Policy, available at: privacy.html
25. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date. Continued use of HERCHAT after changes means you accept the updated Terms.
